However the listing agent prefers the NEFAR Purchase and Sale Agreement and very much appreciates that being used.

Before preparing the offer, be aware that lenders are now dictating how buyers' names should appear on the contract. Seller will pay:

1. Real Estate Commission

2. Provided the buyer uses the seller's title company the seller will pay for the Owner's Title Policy

ALL OTHER CLOSING COSTS ARE CONSIDERED TO BE BUYER CLOSING COSTS AND IF PAID BY THE SELLER WILL BE CONSIDERED A SELLER CONCESSION. Any closing costs checked for the seller to pay in Paragraph 9 of the NEFAR Purchase and Sale Agreement will be presented to the seller as a seller concession. This could affect your buyer's offer, particularly in a multiple offer situation

SELLER WILL NOT PAY DEED STAMPS.

Buyer must confirm SF, utilities (septic, sewer, etc.), lot size - anything of importance to buyer. If applicable: amenities, costs of club memberships, covenants and restrictions, HOA requirements and/or restrictions, whether rentals are allowed in the community and whether there is a limit on the number of rentals allowed. Also any requirements that tenants be approved by the association.

Please be sure that buyer understands the following:

BUYER WILL NOT RECEIVE KEYS TO THE PROPERTY UNTIL:

1. All funds have cleared.

2. Seller's title company receives all required ORIGINAL buyer signed documents. If a property closes on a Friday before a Monday holiday, buyer will not receive keys before the following Tuesday at the earliest.

3. Seller's title company gives clearance to release keys.
